Whether you are an Advertiser (being the property owner or agent placing adverts on this site) or a Holidaymaker (persons using the site other than to advertise holiday homes), by accessing or using snowghostski.com, you acknowledge that you are subject to and bound by the following terms and conditions. The terms and conditions constitute a legally binding agreement with Snowghostski. Please read these thoroughly before using the site.

1. Responsibility for accuracy and currency of property information:
Snowghostski.com makes no representation as to the accuracy or currency of the information contained within the Snowghostski website. Whilst every effort is made to ensure that advertised details are accurate and up to date Snowghostski are wholly reliant on the owners advertising on the site to provide accurate and up to date information regarding their properties. Snowghostski is in no way liable for any inaccuracies or misleading statements made in the information provided by the owner or agent of properties on this website.

2. Use of our site:
A condition of your continued use of this site is that you agree not to use this site for any purpose that is unlawful or prohibited by these terms and conditions or by other applicable laws and regulations. Your continued use of the site also signifies that you indemnify Snowghostski from any loss or damage or costs in connection with any breach of these conditions or any other legal obligation by you and your use of, or conduct on the site.

3. Copyright authorities:
The Advertiser represents and warrants that he (a) owns the copyright in the photographic and textual material supplied by him to Snowghostski (the Material) or (b) has been authorised by the owner of the copyright in the Material to grant Snowghostski permission to use the Material. The Advertiser grants Snowghostski a perpetual, royalty-free licence to use the Material for promotional purposes (including marketing and public relations material).

4. Copyright protection:
Material and software on this site is copyright protected. Other than using it for your own personal use the material may not otherwise be used or copied without the prior written approval of Snowsghostski.

5. Liability:
Snowghostki does not warrant that the operation of this web site will be uninterrupted or error free. In no event shall Snowghostski become liable to any advertiser for any incidental or indirect damages, including lost profits , however caused, on any theory of liability.

6. The Advertiser warrants and confirms that:
6.1. The reproduction and/or publication of the Advertisement by Snowghostski as submitted will not breach any contract or infringe or violate any copyright, trade mark or any other personal or proprietary right of any person or render Snowghostski liable to any proceedings whatsoever;
6.2. Any information supplied in connection with any Advert submitted is accurate and true;
6.3. The Advert shall not be obscene or libellous andwill comply with the requirements of all relevant legislation for the time being in force or applicable in the United Kingdom; and
6.4. All advertising copy submitted to Snowghostski is legal, decent, honest and truthful and complies with the British Code of Advertising Practice and all other relevant codes under the general supervision of the Advertising Standards Authority;

7. Multiple properties:
A property advertisement on Snowghostski.com will relate to one holiday unit unless prior written permission has been given to the advertiser. Snowghostski reserve the right to amend any property adverts not adhering to this policy.

8. Exchanging properties:
A property advertisement on Snowghostski.com relates to a specific property. This property listing will not be substituted for another by way of changes to the text and or photographs other than in exceptional circumstances. The decision as to what constitutes “exceptional circumstances” is a matter solely for the partners of Snowghostski and each such request shall be considered on its own merits.

9. Termination of a property page:
If Snowghostski receives substantiated complaints from any number of site users about a specific Property Page misrepresenting the property, or its surroundings, then we reserve the right to remove the Property Page without notice, and retain payment. Snowghostski reserves the right to refuse to list any Property Page where the content fails to meet our minimum requirements or it is believed that the proposed listing contains inaccuracies or untruths. If advertisers wish to have their Property Page removed from the web site one months notice is required in writing (email will be sufficient for these purposes). The page will be removed from the site at the conclusion of the notice period (31 days from the date that notice is received by us). The advertiser will be obliged to honour any and all existing bookings regardless of the circumstances of removal. Furthermore during the notice period the advertiser or his agents will continue to make the property’s availability known to Snowghostski and accept bookings from Snowghostski up until the removal date as determined by the notice period.

10. Contact:
In the interest of maintaining a high level of service to holidaymakers using this site, we require all advertisers or their agents to be available to respond to enquiries by telephone or email. Should advertisers be unavailable for a period of more than 1 week, we require them to leave an answer phone message to that effect or set up an out of office response on their email account (whichever is their preferred mode of contact). We reserve the right to suspend the adverts of owners who are unreachable for more than 1 week without prior notice or agreement. In such cases we will send messages by telephone and email asking the advertiser to request re-activation upon their return.

11. Payment details:
Whilst we do not charge a subscription fee for the use of our services we reserve the right to charge an initial non-refundable administration fee of up to £50 GBP for listing advertisements on our site. The level of the fee will depend on the degree to which the advertiser is able to provide the information / images required for the advert. In addition Snowghostski and or their partner companies reserve the right to retain payment to any advertiser where there is or has been any breach of the terms of these conditions or of the contract made between the advertiser as the owner of the property in question and any client of Snowghostski or their partner companies hiring the property.

12. Payments Made by Credit Card
All payments made to Snowghostski by credit card will be subject to a 2% surcharge to cover handing costs. Snowghostski reserves the right to amend and change their charging structure without notice.

13. Booking and Payment
When booking a property a non-returnable deposit of 35% of the total price of the rental will be taken. 10% of this deposit will be paid directly to snowghostski as payment for the introduction service, the remaining 25% will be taken by the owner or his / her agent(s) and will secure the booking of the proerty. The 35% deposit will be deducted from the final payment that will be required in full 30 days prior to arrival. If booking is made less than 30 days prior to arrival, the full amount is due immediately and must be paid by credit card only. No personal cheques can be accepted within 30 days of arrival.

14. DAMAGE/SECURITY DEPOSIT:
To insure against damages to the accommodation, a refundable damage deposit of at least $500.00 for each unit is taken on a Visa/MasterCard/American Express on the day of check-in. This deposit is used for any additional charges such as damage done to the property, hot tub misuse, parties, events, lost keys, or if excessive cleaning is required. The charge for lost keys is $75.00 per set as the relevant locks must be re-keyed. Our partners on the mountain inspect all accommodation before and after a renter’s stay for damage, lost items and cleanliness. Renters are fully and legally responsible for any charges over and above the collected damage/security deposit and the renter hearby authorises snowghostski.com and or their partners to attach and collect any additional charges to their credit card. If no charges are incurred, the damage deposit will be released within 10 days of departure.

15. CANCELLATION:
For bookings made more than 30 days prior to arrival: A renter has up to 48 hours after the booking is made to cancel without penalty. If notice of cancellation is given after the 48 hours and before full payment is made (30 days prior to arrival), then the non-refundable booking deposit is kept. If notice of cancellation is made less than 30 days prior to arrival and after full payment is made, the full amount of the rental cost is kept unless a replacement booking is made. If a replacement booking is made, then all monies except the non-refundable booking deposit will be refunded after the new deposit or balance is received. For bookings made less than 30 days prior to arrival: Full payment is due immediately if renter makes a reservation within 30 days of arrival. At this point, a renter has 24 hours after the booking is made to cancel without penalty. If notice of cancellation is given after the 24 hours then the full amount of the rental cost is kept unless a replacement booking is made. If a replacement booking is made, then all monies except 35% will be refunded after the new deposit or balance is received.
